CYBERSMITH warrants that its product is free from defects in material and workmanship and, when properly installed and used, will perform in accordance with applicable specifications. If within one year following original shipment date of a CYBERSMITH system (excluding the motorized toys) if a component is found not to meet manufacturing standards, we reserve the option to repair or replace defective equipment at no charge when it is returned to an authorized CYBERSMITH service facility. The motorized toys are warranted for the first ninety (90) days of the one year warranty period. Transportation cost to and from the service facility is NOT covered under warranty. IT IS THE PURCHASER'S RESPONSIBILITY TO RETURN THE DEFECTIVE EQUIPMENT AND TO PACKAGE THE EQUIPMENT IN A MANNER TO AVOID FURTHER DAMAGE. Return shipping cost, labor and/or parts [if non-warranty] will be billed prior to the return shipment. CYBERSMITH shall not be liable for any indirect, special or consequential damages, even if notice is given of the possibility of such damages. Warranties do not cover breakage or failure occasioned by tampering, misuse, carelessness, accidents or modifications, or if equipment is repaired by other than an authorized service center. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE.
